HULA HIPS – Terms & Conditions (In-person Classes)
1. Definitions
Hula Hips means Juanita Lia-Norris trading as Hula Hips (ABN 35 547 500 534).
You means the individual named on the Registration Form as the Student, or Parent/Guardian if the Student is under 18, and Person Responsible for Paying Fees.
Term is defined as a period of 10 weeks.
Fees means the fees set out in the Class Fee Schedule at hulahips.com.au/classes/.
2. Conditions of Enrolment
By submitting this Registration Form, you agree to abide by these Terms and Conditions. The Student must be medically fit to attend classes. Hula Hips reserves the right to cancel or change classes at any time. The minimum enrolment period is one class. For new students joining after the start of a term, fees will be charged pro-rata.
3. Fees
All prices are in Australian dollars and do not include GST. Full Term Fees are due no later than the end of Week 2 of the term. Casual Class Fees are due before the class commences. Fees cannot be rolled over to the next term. There will be no discounts, refunds or credits for missed classes. Hula Hips does not offer free trial classes — new students may enrol for a Casual Class if unsure about committing to a full term.
4. Refunds
Unless otherwise stated, if a Student misses a class or withdraws from Hula Hips for any reason, you will not be entitled to a refund of fees. Hula Hips may, at its absolute discretion, provide a booking credit or refund for withdrawal due to illness or injury, provided medical proof is supplied. There are no refunds for costume hire, concert tickets, registration fees or showcase tickets.
5. Expectations
Students are expected to attend all scheduled classes. Hula Hips must be notified of any absences. Students must arrive 5 minutes before class, dressed in correct uniform with lava lava tied and folded over. You are not permitted to enter a class in progress unless invited. Recording from any device during classes is strictly prohibited. Students enrolled at Hula Hips cannot also participate in classes at another dance studio.
5.11 Student Health & Safety
Students are responsible for ensuring they are adequately nourished and hydrated prior to class. Students are expected to be aware of their own physical limitations and participate safely within those limits. If a student feels unwell or physically strained at any time, they are encouraged to take a break, hydrate, or use the restroom. Hula Hips and its instructors accept no liability for consequences resulting from a student exceeding their own physical limits.
5.12 Intermediate Class
The Intermediate class is by invitation only. There is no casual drop-in option for this class. Intermediate students are strongly encouraged to also attend the earlier Vahine class on Saturdays to enhance stamina and fitness.
6. Intellectual Property & Photography
Hula Hips is the owner of all photographic, digital and audio-visual recordings taken of you or your child by or on behalf of Hula Hips at any class or event. You are not entitled to remuneration in respect of Hula Hips' use of these recordings. All choreographed dances may only be used for performances with prior written permission from Hula Hips, and Hula Hips must be acknowledged on any platform the footage is uploaded to. By registering, you acknowledge that Hula Hips classes and events may be photographed or filmed for promotional and social media purposes. If you do not wish to be included, please notify Juanita directly before class.
7. Personal Conduct
You must conduct yourself in a civil, safe and proper manner at all times. Hula Hips has zero tolerance for bullying or intimidating behaviour. Any such behaviour may jeopardise your enrolment and no refunds will be given.
8. Loss and Damage
Hula Hips is not responsible for any loss, theft, or damage to personal property. Personal property is brought to classes at the Student's own risk.
9. Release and Indemnity
Classes entail certain risks, including the danger of personal injury, which cannot be fully eliminated. The Student voluntarily elects to attend and assumes all risks of loss, damage or injury. To the extent permitted by law, you agree to release, indemnify and hold harmless Hula Hips and its Personnel against all expenses, costs, liabilities, claims, damages and losses arising from attendance or participation in classes.
10. Liability
To the extent permitted by law, Hula Hips' aggregate liability is limited to the amount paid by the Student for the Services subject to the liability.
11. Privacy Policy
Hula Hips will not sell, rent or trade your personal information to any third party. Information collected during registration is used solely to manage studio business. Hula Hips will only share your information with third parties: (i) as needed for studio business; (ii) if required by law; or (iii) to protect the rights or safety of the public. 12. Force Majeure
Hula Hips shall have no liability if prevented from or delayed in performing its obligations due to events beyond its reasonable control.
13. General
This Agreement is governed by the laws of Queensland, Australia. Hula Hips reserves the right to amend these Terms and Conditions from time to time. All changes will be posted on the Hula Hips website. Continued enrolment constitutes acceptance of the most recent version.
